Thailand Visa for Foreign Parents of Thai Children — Non-O Guide
Foreign nationals who are the parents of a Thai child can apply for a Non-Immigrant O (Non-O) visa based on that relationship — allowing them to stay in Thailand long-term without needing employment or retirement qualifications. Here is exactly how it works and what is required.

THE LEGAL BASIS
Under Thai immigration regulations, a foreign national who is the parent of a Thai child (born in Thailand with Thai nationality) qualifies for a Non-Immigrant O visa based on the "guardianship/maintenance of a Thai national" category. This is the same visa category as the marriage visa — Non-O — but used in the context of a parent-child relationship rather than a spousal one.
This route is commonly used by:
- Foreign fathers of Thai children (where the mother is Thai and the child holds Thai nationality)
- Foreign mothers of Thai children (less common as Thai nationality typically follows through the mother automatically, but applicable in some circumstances)
- Non-married foreign parents: the parental relationship does not require you to be married to the Thai mother/father
INITIAL NON-O VISA
As with the marriage-based Non-O, the initial visa is typically obtained at a Thai consulate or embassy abroad (yielding a 90-day entry stamp) or by changing status in Thailand at the Immigration Bureau.
DOCUMENTS FOR THE INITIAL NON-O (AT CONSULATE):
- Passport (valid 18+ months)
- Application form and photos
- Thai child''s birth certificate (original or certified copy) showing your name as parent
- Thai child''s Thai national ID card or house registration (tabien baan)
- If not married to the child''s Thai parent: any available documentation establishing your parental relationship (court custody order, acknowledgment of paternity at amphur, etc.)
ANNUAL EXTENSION REQUIREMENTS
The annual extension is where the ongoing requirements become specific:
FINANCIAL REQUIREMENT:
Same as marriage-based Non-O:
Option 1 — Bank balance: 400,000 THB in a Thai bank account, seasoned for 2 continuous months before extension
Option 2 — Monthly income: 40,000 THB/month in overseas income
DOCUMENTS FOR ANNUAL EXTENSION:
- TM7 extension application form
- Passport + copies
- TM30 receipt (current address registration)
- Thai child''s birth certificate (copy)
- Thai child''s Thai ID card or house registration
- Evidence of the parental relationship (if there is any ambiguity — e.g. the birth certificate does not name you as parent and you are seeking to establish paternity)
- Map of your residence
- Photos of you with the child at your home
- Bank passbook + bank letter (if using bank balance method)
- 1,900 THB extension fee
THE CHILD MUST RESIDE IN THAILAND
The Non-O extension for parents of Thai children requires that the Thai child is actually living in Thailand. If the child has relocated abroad with the Thai parent, the basis for the extension may be questioned. This is not always enforced strictly — but it is the underlying purpose of the visa category.
PATERNITY ACKNOWLEDGMENT (FOR UNMARRIED FATHERS)
If you are the foreign father of a Thai child but are not married to the Thai mother, Thai law requires formal acknowledgment of paternity at the local Amphur (District Office) for the child to have the father''s name on the birth certificate and to establish the legal parental relationship that supports the Non-O. If the child''s birth certificate does not show your name, the Non-O application is more difficult.
Process: attend the Amphur with the Thai mother and the child. The father signs an acknowledgment of paternity form. If the mother or child objects, the matter becomes a court matter (DNA testing, court order). In straightforward cases, the Amphur acknowledgment is same-day.
COURT CUSTODY ORDERS
If there is a custody dispute or the child''s other parent has sole legal custody, a court order may be required to establish your legal right to maintain the parental relationship that supports the Non-O. Visa Centre recommends consulting a Thai family lawyer in these circumstances.
WORK RIGHTS ON NON-O (PARENT CATEGORY)
No work permit is included. If you wish to work in Thailand while on a Non-O (parent category), you need a separate work permit obtained through an employer.
